Employers must be proactive and anticipate the needs of a diverse workforce.  We routinely provide advice to our employer clients on how to prevent and address issues related to workplace discrimination, harassment and accommodation. We also appreciate the need to employ thoughtfulness and consideration when human rights concerns arise. We offer practical and balanced advice to address human rights issues that emerge in the workplace.

Compliance

We help ensure that your policies and procedures are in-line with current guidance from Human Rights Commissions and case law.  We work with our clients so problems can be solved before they arise. We can help manage risk by drafting and implementing anti-harassment, anti-discrimination, and accommodation policies tailored to your workplace. These policies should be regularly reviewed and updated annually or otherwise. We offer regular policy reviews to ensure that your procedures are up to date with the current law.

Training

The first step towards preventing discrimination, harassment and accommodation issues in the workplace is making sure that your management team is aware of the framework surrounding human rights law in Canada. We offer training for your management team on various aspects of human rights law including:

  • Prohibited forms of discrimination
  • The duty to accommodate
  • Sector-specific human rights issues, including mandatory vaccination
  • Identifying bona fide occupational requirements

Equity, Diversity & Inclusion

Today’s employers understand the importance of fostering an open and inclusive workplace. We advise on the development of Equity, Diversity and Inclusion programs. We offer Equity, Diversity and Inclusion training programs that educate managers on the changing expectations and norms regarding how employees should be treated at work by their peers and their leaders.  We also help employers prepare equity surveys and advise on special programs for hiring underrepresented groups.

Accommodation

No two employees and no two workplaces are exactly alike.  Accommodation needs and the ability to meet those needs requires a case-by-case analysis.  We help develop individualized accommodation solutions where they are possible and advise on alternative options where they are not.

Litigation

We have a proven track record representing clients before the Human Rights Tribunal of Ontario and other human right tribunals in different jurisdictions.  For any matter that cannot be resolved at mediation, we will prepare a case that is thoughtful, and we will  vigorously advocate for our clients.
