Compliance is an increasingly complex issue in employment law. There are over 100 statutes in Ontario alone that regulate employment directly or indirectly.  We advise on all aspects of the employment life cycle from recruitment to termination, with a goal of maintaining compliance and avoiding litigation.  Our expertise includes:

Compliance

  • Minimum standards
  • Occupational health & safety
  • Workers’ compensation
  • Pay equity
  • Public sector compensation
  • Accessibility
  • Privacy
  • Obligations on buying or selling a business

Employee Management

  • Accommodation
  • Workplace policies
  • Drug testing policies
  • Lay-offs
  • Performance management and discipline
  • Terminations
  • Remote work
  • Attendance management

Contracts

  • Offer letters
  • Employment contracts
  • Independent contractor agreements
  • Dependent contractor agreements
  • Intellectual property agreements
  • Non-solicitation and non-compete agreements
  • Confidentiality agreements
  • Sales compensation agreements
  • Incentive plans

Litigation

Despite all efforts, litigation is sometimes unavoidable.  Our lawyers have litigated before all levels of courts in Ontario including claims related to:

  • Wrongful dismissal and associated discrimination claims
  • Constructive dismissal
  • Non-solicitation and non-competition claims
  • Other employment related contractual claims

Our approach to litigation is to strategically manage the cost at all steps in the process. Where settlement is possible, we will seek an early resolution to minimize the legal fees expended.  Where settlement is not possible, we will work with our client to find the best and most cost-effective path to achieve their goals.
